How many people are killed on Massachusetts roads each year?
The Massachusetts Department of Transportation maintains a continually updated database of traffic accidents and fatalities. As of October 2022, they report 356 motor vehicle accident deaths since January of the same year. The previous year, 2021, saw 418 fatalities. These deaths included:
- Drivers and passengers
- Pedestrians
- Motorcycle operators and passengers
- Bicyclists
Nationwide, 38,824 people lost their lives in car accidents in 2020, per the Insurance Institute for Highway Safety (IIHS). They report, “These deaths occurred in 35,766 crashes involving 54,272 motor vehicles. This was a 7 percent increase in deaths compared with 2019.”
Who can file a claim after a fatal Boston car accident?
If someone loses their life in a car accident, Massachusetts law allows their surviving family members to bring a wrongful death lawsuit against the driver who caused the accident. Massachusetts General Law Chapter 229, Section 2, provides a cause of action for wrongful death.
According to its provisions, a family – specifically, “the executor or administrator of the deceased” – can hold an individual or entity whose negligent conduct caused the death of their loved one liable. Damages include any conscious pain and suffering experienced by victim, the loss to the family of the person’s reasonably expected financial support, and most important, the loss of that person’s love and support. If gross negligence or reckless conduct was involved, the family may be entitled to recover punitive damages. In most cases, you only have three years to make a claim; seeking qualified legal representation as soon as possible is in your best interest.
These cases are often complicated and may require testimony from qualified experts. It is important to enlist an experienced fatal car accident attorney in Boston when bringing a claim. The team at Breakstone, White & Gluck can help.
How do fatal car accidents happen?
According to the IIHS, in 2020, “speeding was a factor in 29 percent of motor vehicle crash deaths,” and “speeding has been a factor in more than a quarter of crash deaths over the past decade.” Another six percent of deaths were coded by authorities as distracted driving (like texting behind the wheel). Other factors contributing to distracted driving include:
- August has the most fatal car crashes, while April has the fewest
- Almost half of all fatalities occur on weekends – Friday, Saturday, Sunday
- 1 of every 3 deaths happen between 3:00pm and 9:00pm
- The 4th of July typically has the highest amount of traffic fatalities each year
Drunk driving and driving while fatigued can also cause fatal accidents.
What is the value of my Boston fatal car accident claim?
After a fatal car accident, families likely face substantial expenditures, including medical bills and funeral expenses. In addition to recovering compensation for these costs, families who bring a wrongful death lawsuit also can seek compensation for the loss of their loved one’s companionship and financial support. In cases in which the at-fault driver engaged in reckless conduct, such as drunk driving, the family may also request punitive damages, with the assistance of our Boston fatal car accident attorneys. This is known as a gross negligence claim.
In situations in which the decedent’s negligent conduct may have contributed to the accident, the defendant can offer evidence suggesting that the decedent was partially at fault. If the defendant can show that the deceased victim was over 50 percent at fault for the crash (a law called comparative negligence), the family may be barred from recovery. The Massachusetts lawyers at Breakstone, White & Gluck can help you fight back against this type of allegation and ensure your rights are protected at all times.
