We have a business and we procured insurance and the insurance policies were put in place to protect our company and our clients. And there was a situation that arose and the insurance companies pointed the other direction. And we had a business issue to deal with and we went through two other attorneys; it was a very complicated issue – and we found David because of his expertise in working with insurance companies and dealing with insurance malpractice.

So we worked with David and that’s what brought us to the firm is the business issue that occurred. I think the highlights are, number one, he was easily able to dissect what the issues were and shepherd us through a process. Kept us informed during the entire process, and gave us realistic expectations and outcomes.

it was complicated because there were multiple insurance companies, multiple insurance brokers who may have misrepresented the that they were selling, and he was able to untangle all that and work through the court system. We went through the trial court we went through appeals courts and although each step was time consuming we were given realistic expectations and we were one at every gate.

This was an extremely complex and rather prolonged case. Our clients were entrepreneurs with a great strategy for handling company payrolls. They diligently sought insurance protection to ensure that they, and their clients, would not suffer economic loss in the event of theft. Unfortunately, despite receiving detailed company information, the brokers for the two key insurance policies failed to obtain proper and adequate insurance.

Then the worst happened: a processing company engaged in a massive fraudulent scheme, robbing the clients and their clients of large sums of money.

Defendants in the case included two insurance companies and two insurance brokers. There were claims by the companies against our clients for the funds that had been lost in the theft.

The litigation involved multiple summary judgment motions, and an appeal on a question of law which was heard in the Massachusetts Appeals Court. The case finally was winnowed down to one broker as defendant. This broker professed to have a high degree of competence, but depositions in Maine revealed that he was actually incompetent and lacking knowledge about the very product that he was selling.

By the time the case settled, the customers of our clients had received payment for the losses they had sustained. Settlement funds were received from the insurance companies for both of the insurance brokers. The case required detailed understanding of fine points of insurance law, the Consumer Protection Act (G.L. c. 93A), civil procedure and appellate procedure.

On a personal note, we enjoyed working with our clients in this case. They were intelligent, motivated, hard-working family people. It was an honor to represent them.
